There are various types of users of BahamaGigs. Except where indicated otherwise, these BahamaGigs Terms and Conditions apply to all users. By using BahamaGigs Business, you represent and warrant that you are of legal age to form a binding contract and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use BahamaGigs.
“Services” are services offer on BahamaGigs.
“Client” shall refer to all types of users and businesses on BahamaGigs.
“Freelancers” are users who offer and perform Services on BahamaGigs.
“Jobs” is the formal agreement between a Client and Freelancer after a purchase Freelancer’s Gig/Service Page.
BahamaGigs User Account
General. BahamaGigs is a freelance platform for online or offline businesses. Through BahamaGigs, Freelancers can offer their Services online to Clients through formal agreements called Jobs, use a payment method, track their project’s progress, and consolidate feedback—all in one place.
In Job to access and use BahamaGigs, you must first register and create an account on BahamaGigs (“Account”). When opening an Account you represent and warrant that you are authorized to bind the Client and yourself to these BahamaGigs Terms and Conditions.
Upon completion of your registration to BahamaGigs, the Account will be created for your organization. The Client shall be the sole and exclusive owner of the Account including any data, Jobs, and deliveries. In case of a dispute regarding the identity of the Client, BahamaGigs reserves the right to determine the identity of the Client at its sole discretion, whether or not an independent investigation has been conducted by us. However, if we cannot make such determination (as we may deem in our sole discretion), we reserve the right to avoid doing so and/or suspend the Account, without liability to the Client or any other party. We reserve the right to request any form of verification we deem necessary from the Client.
By creating an account, you agree:
- to provide BahamaGigs with accurate, complete, and current registration information;
- to acknowledge that it is your responsibility to ensure that your password remains confidential and secure;
- be fully responsible for all activities that occur under your Account;
- to promptly notify us in writing if you become aware of any unauthorized access or use of your Account and/or any breach of these BahamaGigs Terms and Conditions;
- the Client and you (jointly and severally) will be responsible and liable for any losses, damages, liability and expenses incurred by BahamaGigs or a third party, due to any unauthorized usage of the Account by either you or any other user or third party on your behalf.
A Business Account can only be close by the Client or BahamaGigs. BahamaGigs reserves the right to put an account on hold or permanently disable accounts should we notice any activity that we determine to be fraudulent or inappropriate, or due to breach of these BahamaGigs Terms and Conditions. Clients with disabled accounts, will not be able to conduct trade on BahamaGigs.
Subscription Fee, Term and Renewal
Through our payment processors (PayPal) when you make a payment, we receive the payment details from these websites. We keep the data safely only for billing purposes, or invoice purposes. We do not store that data to send our promotional or unsolicited emails to you without your consent. When using the payment processor (PayPal), you are subject to their terms and conditions.
Subscription Fee. The subscription term can vary between 1 to 12 months and set to auto-renew at the end of each term. The subscription fee is for:
- Freelancers who wish to advertise their Service on the landing page of the BahamaGigs website;
- Clients who wish to post full-time jobs for users and have Freelancer referred to them by BahamaGigs
Although the Subscription Fee is non-cancelable and non-refundable, users can cancel the Subscription at any time. Any decline or failure to collect Subscription Fee due by Client (“Chargeback”), will be deemed as a breach of Client’s obligations hereunder, and therefore Client’s Business Account may be downgraded, disabled, or terminated (at BahamaGigs’ soles discretion) until payment of applicable Subscription Fees in full.
Client hereby authorizes BahamaGigs to charge the Subscription Fees, upon due date, from any other payment method selected by Client for this purpose. Upon a Subscription upgrade, the Client will be billed for the applicable increase in Subscription Fee, at BahamaGig’s then-current rates.
Discounts and Promotions. Unless expressly agreed otherwise, if Client received a special discount or other promotional offer, Client acknowledges that upon renewal of its Subscription, the Subscription will renew, at the full applicable Subscription Fee at the time of renewal.
Taxes. The Subscription Fee is exclusive of any and all tax (including without limitation, value-added tax, sales tax, excise, goods and services tax, levies, or duties, etc.) which may be imposed with respect to these BahamaGigs Business Terms and Conditions.
Validate Services on BahamaGigs
Jobs are completed once payment is made by the Client. You may request a specific service from Freelancers using the “Post a Request” feature. Such a request can only made for service allowed on BahamaGigs. These allowed services include those strictly related to the Categories on our website, https://bahamagigs.com/.
You should refrain from using the “Post a Request” feature for any purpose other than looking for services on BahamaGigs. We encourage Clients and Freelancers to try and settle Job conflicts amongst themselves. If such efforts fail or if you encounter non-permitted usage by other users, you can contact Bahama Gigs Customer Support department for assistance at firstname.lastname@example.org
Conduct and Security
User conduct. BahamaGigs maintains a friendly, community-spirited, and professional environment. Users should keep to that spirit while participating in any activity or extensions of BahamaGigs. BahamaGigs may suspend or close an Account of auser deemed to be acting in an unfriendly manner or at our discretion. Reviews. Any Client can leave a review on Jobs placed after the completed Job. All reviews will be publicly display on the Freelancer’s Gig page.
You are responsible for scanning all delivered files for viruses and malware. BahamaGigs will not be hold responsible for any damages which might occur due to site usage, use of the content, or files transferred.
Policy Updates We may make changes to these BahamaGigs Business Terms from time to time. When changes are, we will make a new copy of these BahamaGigs Business Terms available on this page. We may add, modify or discontinue any feature, functionality or any other tool, on the BahamaGigs platform, or suspend BahamaGigs Business altogether, at our own discretion, at any time, and without further notice.
Disclaimer of Warranties.
YOUR USE OF BAHAMAGIGS, BAHAMAGIGS BUSINESS, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE BAHAMAGIGS PLATFORM IS AT YOUR OWN RISK. BAHAMAGIGS, BAHAMAGIGS BUSINESS, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE BAHAMAGIGS PLATFORM ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
NEITHER BAHAMAGIGS NOR ANY PERSON ASSOCIATED WITH BAHAMAGIGS MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY OR AVAILABILITY OF THE WEBSITE. THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE the EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
